How Long Is My Divorce Going to Take?

A common concern in divorce cases is how long the process will take. I have developed a flow chart illustrating different options for divorce and how long each step within that option would take. However, I will work with you to achieve a positive outcome should it be necessary for your to resolve a contested divorce in court. Sign a Separation Agreement First

One of the key elements of a quick and easy divorce is signing a separation agreement. In Virginia, couples must be separated for a minimum of one year to obtain a divorce unless they sign a separation agreement. If you sign a separation agreement and you have no minor children, you must be separated for only six months before you can file for a divorce. If you have minor children, you must be separated for one year before you can file for divorce. It is critical that you at least attempt to enter into a separation agreement while you are waiting to file for divorce.
