I have experience with the complexities of property division during divorce, and I can explain how prenuptial agreements are enforced. Even though Virginia is an equitable distribution state, (meaning all marital property will be divided in a manner the court believes is fair when you divorce), a prenuptial agreement will still be enforceable under Virginia’s Uniform Premarital Agreement Act provisions. While Virginia law governs the new wealth you build together during marriage, the assets specified in your prenuptial agreement will not be divided.
